Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Ourconic Concepts website (the "Site"), a brand of Ourconic, LLC ("Ourconic Concepts," "we," "us," or "our"), and any products or services offered through it. By using the Site, purchasing a product, or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who may use the Site

You must be at least 18 years old to use the Site, purchase products, or engage our services. By using the Site you represent that you are 18 or older and have the authority to enter into these Terms, including on behalf of any organization you represent.

2. Our services

Ourconic Concepts provides AI-assisted creative services and products, which may include but are not limited to content, video, audio and music, prompt packs, prompt libraries, done-for-you production, and responsible-AI advisory services. All creative work is human-directed: a named creative director reviews and signs off on deliverables, as described in our Trust Standard.

3. Prompt Packs and digital products

Prompt Packs and other digital products are sold and delivered through our third-party storefront, Gumroad. When you purchase a digital product, your transaction, payment, and delivery are handled by Gumroad under its own terms and privacy policy. We do not process or store your full payment card details.

Because digital products are delivered immediately and cannot be returned, all sales of digital products are generally final. If you experience a problem with a purchase, contact us and we will work with you in good faith. Refunds, where offered, are handled through Gumroad.

4. Done-for-you and custom services

Custom and done-for-you engagements are governed by the specific scope, timeline, and price we agree with you, which may be set out in a separate proposal, statement of work, or services agreement. Where a separate signed agreement exists, that agreement controls if it conflicts with these Terms. Deposits and payments for custom work are non-refundable once work has begun, except as required by law or as otherwise agreed in writing.

5. Intellectual property & ownership of work

The Site, our brand, logos, badges, and original content are owned by Ourconic, LLC and protected by intellectual-property laws. You may not copy, reproduce, or use them without permission.

For commissioned creative work we produce for you, ownership of the final deliverables transfers to you upon full payment, unless a separate agreement states otherwise. We may retain the right to display completed work in our portfolio and showcase, with appropriate disclosure of how it was made, unless you ask us in writing not to.

6. AI-assisted content & disclosure

Our work is produced with a combination of human direction and AI-assisted tools. Every piece we publish or deliver carries a disclosure label indicating how it was made (Human-Directed, AI-Assisted, or AI-Accelerated), and a human reviews work before delivery. You agree that AI-assisted outputs may require your review and that you are responsible for how you use the deliverables once they are in your hands.

7. Acceptable use

You agree not to use the Site or our products and services to:

• Violate any law or the rights of others;
• Infringe intellectual-property rights or misappropriate confidential information;
• Create unlawful, deceptive, harassing, hateful, or harmful content;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Site or its systems; or
• Resell or redistribute our digital products in violation of Section 3.

8. Third-party links & services

The Site links to and integrates with third-party services, including but not limited to Gumroad, Apple Music and other streaming platforms, YouTube and other video platforms, Google, and other Ourconic, LLC websites. We are not responsible for the content, products, or practices of third parties. Your use of those services is governed by their own terms and policies.

9. Disclaimers

The Site and our products and services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. See our Disclaimer for more detail.

10. Limitation of liability

To the fullest extent permitted by law, Ourconic, LLC and its affiliates, members, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site, products, or services. Our total liability for any claim relating to a product or service will not exceed the amount you paid us for that product or service.

11. Indemnification

You agree to indemnify and hold harmless Ourconic, LLC and its members, employees, and contractors from any claims, damages, or expenses arising from your misuse of the Site, products, or services, your violation of these Terms, or your violation of any law or third-party right.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute relating to these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
